Acceptable Use Policy

The rules for what you broadcast, store, and do on the platform.

This policy forms part of the Terms of Service. It sets out what may not be broadcast or stored through RadioHeart, what may not be done to the platform, and what happens when those rules are broken.

It exists because we do not pre-screen what customers transmit. The obligations here are yours to meet, and the enforcement ladder is what we can do when they are not met.

1. Scope

This Acceptable Use Policy (the “AUP”) applies to everyone who uses the Service — account owners, co-hosts, volunteers, staff, students, contractors, and anyone else broadcasting through your Station. You are responsible for their compliance as if it were your own.

The lists below describe categories, not an exhaustive catalogue. Conduct that is plainly within the spirit of a prohibition is prohibited even if it is not spelled out.

2. Prohibited content

You must not upload, store, schedule, stream, or otherwise transmit through the Service any material that:

  • infringes copyright, neighbouring rights, trade marks, or any other intellectual property right — including music, jingles, imaging, podcasts, sports commentary, audiobooks, or film and television audio you are not licensed to broadcast;
  • is music or other audio for which you do not hold every required master, publishing, mechanical, and public-performance licence for every territory your Station reaches;
  • is unlawful in a territory you knowingly broadcast to, or that promotes, facilitates, or provides instructions for unlawful activity;
  • sexually exploits or endangers a child in any way, including child sexual abuse material — such material is reported to the competent authorities and results in immediate termination;
  • incites or threatens violence, or harasses, bullies, defames, or targets a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation;
  • is fraudulent, deceptive, or misleading, including impersonating a person, broadcaster, brand, or public authority, or falsely presenting your Station as endorsed by or affiliated with someone;
  • contains malware, exploit code, or anything designed to disrupt or gain unauthorised access to a system;
  • discloses another person’s private or personal information without a lawful basis and their consent, where consent is required;
  • breaches advertising, sponsorship, gambling, alcohol, tobacco, financial-promotion, medical-claim, political-communication, or children’s-content rules that apply to your programming or your territory.

3. Prohibited conduct

You must not:

  • probe, scan, or test the vulnerability of the Service, or breach or circumvent any authentication, rate limit, or security measure, other than under a written authorisation from us;
  • circumvent or artificially inflate listener, storage, bandwidth, station, or co-host limits, including by operating multiple accounts to split a single logical station across plans;
  • resell, rent, sub-license, or otherwise make the Service’s capacity available to third parties as your own service, unless a written agreement with us permits it;
  • share one set of credentials among people who should each hold their own, or transfer an account to someone else without our consent;
  • send spam or unsolicited bulk messages through any Service feature, including chat and listener messaging;
  • scrape, crawl, or systematically extract data from the Service, or use automated means to access it other than through documented APIs within their published limits;
  • use the Service in a way that imposes an unreasonable or disproportionate load on infrastructure, degrades performance for other customers, or interferes with the delivery of their streams;
  • reverse-engineer, decompile, or attempt to derive source code from the Service, except to the extent that restriction is prohibited by law;
  • remove, obscure, or alter any proprietary notice, or misrepresent the origin of a stream.

4. Your licensing duty, in operational terms

In practice that means:

  1. Identify the rights your programming needs in each territory you reach — master, publishing and mechanical, and public performance or communication to the public.
  2. Obtain the licences from the rightsholders or the relevant collecting societies before you broadcast, and keep them current.
  3. Keep the reporting your licences require. Play logs and analytics exports from the Service can help you prepare that reporting, but they are not a licence and do not discharge any obligation you owe.
  4. Remove material promptly if a licence lapses, is refused, or is withdrawn.
  5. Check your obligations again when you add a territory, a distribution platform, a directory listing, or a mobile app.

If you are unsure what you need, take advice from a qualified professional or from the relevant collecting society. We cannot advise you on your licensing position.

5. Listeners, chat, and personal data

Your Station is your relationship with your audience. Where you collect personal data from Listeners — through chat, requests, competitions, sign-up forms, or analytics you configure — you act as the controller of that data.

  • Publish your own privacy notice to your Listeners and identify a lawful basis for your processing.
  • Obtain any consent required for cookies, tracking, or marketing you place on your own pages or apps.
  • Moderate your chat and listener interactions, and act on reports of abuse in them.
  • Respect data-subject rights when a Listener exercises them against you, and pass on to us without undue delay any request that concerns data we process on your behalf.
  • Do not use the Service to build profiles of Listeners in ways your notice does not disclose, or that mandatory law does not permit.

The Privacy Policy explains the division of roles, and the Data Processing Addendum governs the data we process on your instructions.

6. Enforcement

Where we reasonably believe this AUP has been breached, we may take one or more of the following steps, choosing the response proportionate to the seriousness and the risk:

  1. Warning — we contact you and ask you to correct the problem within a stated time.
  2. Content removal — we remove or disable access to the specific material at issue.
  3. Suspension — we suspend a Station, a feature, or the account while the matter is resolved.
  4. Termination — we close the account, including immediately and without prior warning for serious breaches such as child sexual abuse material, repeat infringement, or an attack on the Service.

Repeat infringement of copyright is handled under the Copyright & Takedown Policy, which includes an account-termination policy for repeat infringers.

7. Reporting a violation

To report content or conduct that appears to breach this policy, email support@radioheart.io with the Station name or stream URL, the date and approximate time, a description of what you observed, and how we can contact you. Copyright complaints should instead follow the notice procedure in the Copyright & Takedown Policy, which has statutory requirements a general report does not satisfy.

We review reports and act where we consider action is warranted. We do not undertake to report the outcome of an investigation to the person who raised it, and we do not adjudicate disputes between customers and third parties.
